The Legal Impact of Artificial Intelligence on Judicial Expert Reports: An Analytical Study

This research aims to study the legal impact of artificial intelligence on the judicial expertise report, by demonstrating the extent of the impact of using algorithmic tools on the nature of the report, its probative force, the controls for its acceptance before the court, the guarantees necessary for its discussion, and liability for algorithmic error. The research adopted the analytical approach by analyzing the rules regulating judicial expertise in Palestinian and Jordanian laws, while drawing upon modern trends in regulating artificial intelligence, particularly regarding transparency, explainability, human oversight, and accountability.
The research discussed in its first section the nature of the AI-supported judicial expertise report and forms of its use in the expert's work, then the probative force of this report and the controls for its acceptance before the court. The second section was dedicated to discussing the guarantees of transparency, explainability, the principle of confrontation, and liability for algorithmic error and its effect on the validity of the expertise report.
