The Iraqi-Kuwaiti Border Dispute and the Construction of Mubarak Port

The principles of public international law state that land and maritime border demarcation must be based on the free will of states, mutual consent, and the principles of good neighborliness. The research problem highlights the conflict arising from the maritime border demarcation between Iraq and Kuwait and the Security Council's intervention to adopt it in a precedent that violated international rules, resulting in the establishment of Mubarak Port in a narrow navigational channel that threatens to make Iraq a landlocked country.
The study adopted the descriptive-analytical approach to address the conflict and its related decisions. It concluded that the demarcation commission relied on flimsy British maps from 1932, and the Security Council ignored the 1982 Law of the Sea Convention regarding Iraq's right to participate, depriving it of its maritime rights.
