The Legal Nature of Exceptional Systems and their Impact on the Legislative and Executive Authority

The research aims to analyze the legal nature of exceptional circumstances and how they affect the legislative and executive branches in different legal systems. The focus is on distinguishing between exceptional and ordinary systems in terms of how authorities are managed, in addition to highlighting the impact of these circumstances on the balance of powers and their effect on the exercise of legislative and executive powers. The study relied on a comparative analytical approach, examining exceptional systems in multiple legal contexts, with a focus on analyzing relevant legal texts related to both national and international constitutions. It also addressed practical cases where exceptional circumstances are applied, whether during periods of war or political crises. The study concluded with a set of findings, the most important of which is that exceptional circumstances are extraordinary situations that require unconventional measures to address them, such as disasters, wars, and political or security crises, which reinforces the need for special legislation to regulate them.
