Possession claims and their problems in Iraqi courts (An analytical study)

The researcher discussed the study of the possession claim and its problem, which is considered one of the claims that the legislator has written for the possessor whose possession has been violated by resorting to the judiciary to repel this attack and recover his possession. This lawsuit is one of the lawsuits filed by the owner who has completely lost his possession of the property or the real estate, meaning that the property right has left the owner’s hands and passed to the defendant, provided that the possession meets all its legal. These lawsuits showed that they were initiated to protect possession as a legal center and evidence of the right to property. These lawsuits were initiated to protect the legal system and to investigate them in the right lawsuit. It was necessary to study the issue of possession first and then study the remaining details of the property lawsuit. Therefore, the issue of possession occupies great importance in daily life, especially in comparative civil laws, which have given special importance by stipulating it in the legislation addressed by the judiciary, in which the judge has an important role by exercising his own legal conditions and main elements, including the parties, the competent court, the term, rulings, and other topics. The goal of these lawsuits is to maintain the course of public order, the security and stability of society, and the stability of transactions.
