Diplomatic espionage according to public international law

Diplomatic representation serves as a link, an official channel, and an effective language between states, facilitating understanding, negotiation, and the protection of national interests. It also enables diplomatic envoys to fulfill their duties free from pressure or obstacles from the host state. International efforts have undertaken the task of codifying and regulating the functions of diplomatic missions under the Vienna Convention on Diplomatic Relations of 1961. This convention grants the head and members of a diplomatic mission rights, privileges, and immunities commensurate with the nature and functions of diplomatic missions, while emphasizing the necessity of respecting the laws of the receiving state and ensuring that these rights and privileges are not exploited to interfere in its internal affairs. Diplomatic espionage is not limited to a single form or specific activity. Rather, it can be carried out through diverse and varied activities and methods that pose a clear threat to the internal security of the host state. Therefore, if a member of a diplomatic mission engages in espionage activities, the host state is obligated to expel the accused individual or declare its unwillingness to accept their presence within the accredited diplomatic corps. Diplomatic espionage constitutes a genuine abuse of these rights established under international law, given that espionage is incompatible with the nature of the duties entrusted to members of a diplomatic mission.
