يُعد الخبراء من العناصر الأساسية في التحكيم في منازعات الهندسية الإنشاءات، إذ يقدمون المعرفة الفنية المتخصصة التي تساعد هيئات التحكيم في البت في النزاعات ذات الطابع الفني المعقّد. وتُعد تحليلاتهم المحايدة في مسائل مثل التأخيرات، وعيوب التصميم، وتقدير التكاليف، ضرورية وحاسمة لاتخاذ قرارات مبنية على فهم علمي دقيق.
يُعيَّن هؤلاء الخبراء إما من قبل الأطراف المتنازعة أو من قبل هيئة التحكيم، ويقع على عاتقهم الالتزام بالاستقلالية والموضوعية والحيادية التامة، وفقاً للمعايير الأخلاقية والقواعد الإجرائية القانونية، مثل القواعد الخاصة بالأدلة المعتمدة من قبل رابطة المحامين الدولية في التحكيم الدولي الهندسي. وتشمل مهامهم تقديم آراء محايدة وغير متحيزة، والإفصاح عن أي تضارب محتمل في المصالح، ومساعدة هيئة التحكيم في فهم الجوانب الفنية التي قد تخرج عن نطاق تخصصها القانوني.
ومن الجدير بالذكر أن الشهادة الفنية الفعّالة قد يكون لها تأثير كبير في نتائج التحكيم، لاسيما عند تناول القضايا التقنية المعقدة المرتبطة بمشاريع البناء الهندسية. لذلك، فإن اختيار خبراء ذوي كفاءة وخبرة متخصصة يُعد أمراً حاسماً في هذا النوع من النزاعات، لما له من دور في توضيح الجوانب الفنية الدقيقة وتعزيز عدالة وكفاءة إجراءات التحكيم.
